Notarial Power of Attorney in Colombia: Types, Uses and How to Grant It

A power of attorney is a legal act by which a person (the grantor) authorizes another (the attorney-in-fact) to carry out acts on their behalf. It is a very useful tool for managing procedures without being present.

What is a notarial power of attorney?

It is the document by which representation is delegated to carry out certain acts, such as signing deeds, advancing administrative procedures, or managing commercial matters. When granted before a notary it is called a notarial power of attorney.

Types of power of attorney

General power of attorney

It authorizes the attorney-in-fact to perform broad administrative acts, such as managing assets or representing in business matters.

Special power of attorney

It is granted to carry out a specific act or procedure, such as signing a purchase and sale deed or advancing a particular process.

Common uses

  • Signing pre-sale agreements and deeds
  • Processing documents before public entities
  • Representing in judicial proceedings
  • Managing transfers, withdrawals, or banking procedures
  • Signing contracts on behalf of another person

How is it granted?

A power of attorney can be granted by private document when the law allows it. However, for certain acts (such as real estate sale or judicial representation), a notarial or court-authorized power of attorney is required.

Recommendations

  • Clearly define the scope of the power (general or special).
  • Specify the assets or acts over which delegation is granted.
  • Check whether the procedure requires a notarial or judicial power.
  • Keep control: a power of attorney can be revoked whenever the grantor decides.
